Small claim by merchant after credit card company dispute?

Hi There, I’ve given my credit card number to an agency to book a hotel room for me. I found out the agency did not book the right hotel for me, and I advised my credit card company to dispute those charges successfully. Now the hotel go against the agency and ask for the money. Can the agency file a small claim against me even I did not use the room from that hotel at all?

They can file a claim. The question would be can they WIN it. I don’t think they can win against you since YOU did not book the room. I would refer them to the travel agent or whoever actually booked the room on your behalf. I would not ignore them and I would keep records of all contacts you had with them.

If by some means they do win a suit against you, you can go after the booking agent for reimbursement. If need be, you can take them to small claims court to recover your losses.

Credit Card dispute. Merchant threatens collections.?

This is to clarify an earlier question.
I disputed a credit card charge from a merchant with my Credit Card company. The dispute was found in my favor, not in court, but by my credit card company and the merchants bank. The merchant is now threatening to send it to collections or take legal action. Doesn’t disputing a charge and having it found in your favor take care of any legal or collection action? Otherwise merchants would do that all the time and there would be no point of credit card disputes and no consumer protection. Isn’t this also coverd by the FTC?

You need to understand that the credit card company only acts as a 3rd party in this transaction. If this is a "border line" dispute they would prefer to just give back the money and back out of it.

But your transaction is with the merchant, not with the credit card company. Therefore if your merchant feels you are liable, he can take whatever action is necessary. If you still feel you are right, make him take you to court and dispute it.

If he turns it over to collections, immediately dispute the charge and demand validation. Otherwise, they may put a hit on your credit report. If that happens (and you are still certain you could win in court) then file an action against them for posting unvalidated information on your credit report. You could win $1000 in such a lawsuit.

I just started my internet business and am accepting payments through paypal, but I need more features than paypal can provide me with, like one time offers and such, so I will need to get a merchant account and start accepting payments that way.

Can anyone help me find out more about how to choose one?

Choosing a credit card processor requires a little bit of research that you can do online for free. I’ve been there so I know what you are going through.

I started with paypal too but quickly realized that I needed more features. That’s when I decided to open a merchant account and accept credit cards through a payment gateway.

During my research, I came across http://www.electronictransferservice.com and was able to learn so much about merchant account and credit card processing. I was even able to call them up and talk to a live person.

Now I’m not recommending you sign up with them, but the information on their site is definitely worth reading over, especially their FAQ page.

For example, one of the biggest things you need to keep in mind when picking a credit card processor are the fees.

You have to watch out as some companies have hidden fees and they can add up pretty quickly.

And that’s just one of the things, there are many more details that you’ll have to learn about.

I actually went with another company but the information I learned prior to choosing one proved to be very valuable.

Will the merchant be able to charge my credit card if I leave and sign the CLIENT COPY and take the MERCHANT COPY with me?
I am talking about the "Customer copy" of the credit card receipt
And what if the store looses the receipt I signed?

I would recommend you asking for and keeping track of all your customer copy transactions. Normally merchants are honest but if you kept your copies, most reputable credit card companies allow you to CHALLENGE TRANSACTIONS though it helps if you are a good writer in explaining how these occurred chronologically and have your customer copies of each transaction which is why honest merchants would not think of even doing fraudulent transactions bec a smart customer who keeps tabs of such info that is available both online of all credit card activity as well as over the telephone keeps merchants honest…

FYI I have even misplaced my credit card like twice and if you call your credit card financial institution and explain the situation, they will tell you the date, time, store and amount of your most recent transactions…

Is a crime committed if an employee pays with her credit card for clients purchases?

An employee used her credit card to pay a substantial amount of purchases of over a hundred clients. It can be surmised that the clients paid in cash to said employee. The credit card payments do not tally with the dates the receipts were issued. The credit card payments were made 4 to 60 days after the receipts were issued. This cost the company losses in credit card merchant fees. Is there criminal liability here or is this just a case of a violation of company policy?

Are they legitmate charges to your clients? Were the clients billed?

Remember there is lag time , look at your statements
when you make a purchase, sometimes it doesnt show that it was processed until the next day, for several ones.

One of them is that the merchant forgot to batch out.

Do you even know your only company policy?

What didyou say to him or her when she submitted the receipts to your accountant?

Or are you an employee looking for a way to get her fired or in trouble?

Why doesn’t your company audit these transactions?

Why did your company accept the charges?
